Learned counsel for the petitioner submits that the petitioner intends to file an application seeking amendment in the plaint and in case the amendment is allowed by the trial court, the petitioner may be granted liberty to file an application afresh for appointment of Court Commissioner. If such application is filed and the same is considered favourably by the trial court, the petitioner is at liberty to file an application seeking appointment of Court Commissioner and the trial court may decide the same on its own merits.
