The learned counsel for the applicant submits that, as per the Court's order passed previously in this matter, he tried to issue notices to the petitioner. The notices issued to the petitioner through R.P.A.D could not be served as she was not found on the given address. The learned counsel for the petitioner further submitted that, in the year 2017 itself the petitioner had taken back all the necessary papers from him and despite issuance of notice on two occasions as aforesaid, the petitioner did not respond.

It is significant to note that the petitioner is well aware about the proceedings filed by her in this Court, but she never

(2) 914 CRA-68-2017.odt cared for proceeding with the matter. On the contrary, she did not instruct her own lawyer and took back all the papers from him. Thereafter also the petitioner failed to engage another Advocate despite knowing the filing of this petition by her. Such conduct of the petitioner is highly condemnable and indicates that she is not interested in proceeding with the matter. As such, the petition stands dismissed for default. 3.
