The applicant has challenged order passed by the Trial Court rejecting his prayer for condonation of delay, which was allowed. The applicant was directed to deposit costs of Rs.5000/- before the Trial Court within three weeks, but said order was not complied with. The applicant filed application for recalling or modification of said order. But at present counsel for the petitioner submits that he is ready to deposit Rs.5000/- before the Trial Court. Therefore, he is allowed to deposit costs of Rs.5000/- within a week in the Court of Additional Sessions Judge, Aurangabad.
