Heard the learned Advocate for the Petitioner. Since a short issue is raised which is covered by the proposal forwarded by the Superintending Engineer (ANRC) Ahmednagar dated 16th December, 2022 addressed to the Chief Engineer (Commercial), M.S.E.D.C.L., Bandra (East), Mumbai, this Petition need not be kept pending. 2.

We requested the learned Advocate Mr. Bajaj who is a Senior Advocate on the panel of the M.S.E.D.L., to assist the Court. On request, he caused his appearance.

In view of the above, this Writ Petition is disposed off. Let Respondent No.2 render a decision on the communication dated 16th December, 2022 received by it from Respondent No.3, within a period of 35.wp2978.24.odt

60 days. If the proposal is approved, the payment be made to the Petitioner within 30 days, thereafter. If any interest component is statutorily payable, the same would also be taken into account. If adjustment is permissible in the future bills, subject to the consent of the Petitioner, a decision may be arrived at.
