Pursuant to the interim order passed by this Court, petitioner has deposited amount of Rs.10,00,000/- as directed by the Industrial Court, Latur. The same could not be deposited by petitioner since the State Government did not release fund. It is not in dispute that the said amount is towards retirement benefits of respondent like gratuity, leave encashment and pensionary benefits. Petitioner has also admitted before Industrial Court that respondent is entitled for gratuity of Rs.6,33,000/- and pensionary benefit of Rs.8,47,815/-.

In that view of the matter, purpose of petitioner in filing this petition is served, and nothing remains to be decided in this matter. Writ petition is, therefore, disposed of.

It is made clear that respondent will be entitled to withdraw the amount deposited by petitioner.
