With the consent of the parties, the order passed by the SubDivisional Officer, Shrigonda in R.T.S. Appeal No.11/2013 dated 20th January 2014 is set aside.

In view of submissions made by Mr Gaware, matter be placed before the Deputy Collector who is competent to hear the revision in view of provisions of Section 23 of the Mamlatdar's Courts Act. The Counsel for the petitioner is at liberty to take out appropriate proceedings for conversion of appeal.

All the issues including that of limitation, jurisdiction etc. are kept open.
