O R D E R

The learned counsel for the appellant/claimant Mr. A.T. Kanawade and the appellant No.1 Vijay Annasaheb Devare, learned counsel for respondent No.2 Mr Mohit R Deshmukh along with representative of the respondent are present today. 2.

With the assistance of the learned counsels, we have ascertained identification of the appellants and respondent No.2. They affirms the terms of settlement.

The learned counsels and the parties who are present have placed on record the terms of compromise. Same is taken on record and marked as Exhibit-X for identification.

As per the terms of settlement Exhibit-X, respondent No.2 shall

SB2- FA1303-2014 -2deposit an additional amount of Rs. 3,00,000/-(Rupees Three Lakhs) towards full and final settlement of the claim in this court within stipulated period as agreed between the parties the same is accepted as undertaking.

The appellant shall pay the deficite court fees, if any, within a period of three weeks from today.

6.

The payment of deficite court fees, if any shall be the condition precedent to withdraw the amount.

7.

The first appeal stands disposed of in terms of the settlement Exhibit-X and present minutes of order.

8.

Award be drawn up accordingly.
