Applicant is convicted for the offence punishable under Section 279 of the Indian Penal Code and he is sentenced to suffer Rigorous Imprisonment for 15 days and to pay fine of Rs.1,000/-, in default to suffer Simple Imprisonment for Seven days.

Applicant is also convicted for the offence punishable under Section 338 of the Indian Penal Code and he is sentenced to suffer Rigorous Imprisonment for Two Months and to pay fine of Rs.1,000/-, in default to suffer Simple Imprisonment for fifteen days.

Applicant is also convicted under Section 304-A of Indian Penal Code and he is sentenced to suffer Rigorous ca768.22.odt

Imprisonment for Three Months and to pay fine of Rs.5,000/-, in default to suffer Simple Imprisonment for one month. 4.

Considering the quantum of sentence and that the revision is not likely to come up before the Court for hearing in near future, I am inclined to suspend the substantive sentence. Hence the order.

ORDER

1.

Substantive sentence is suspended till the disposal of the revision.

Applicant be released on bail on his furnishing PR bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with one solvent surety in the like amount in connection with CR No. 54 of 2013 under Sections 279, 337, 338, 304-A of the Indian Penal Code registered with Begumpura Police Station, Aurangabad. 3.

Bail in Trial Court.
