The learned counsel for the petitioner submits that validation proceeding in respect of the Tribe claim of the petitioner is pending with the committee since 2011. It is not yet decided. Though the vigilance is completed the report is not served on the petitioner. The respondents have withheld the result of the petitioner's final year M.B.B.S. examination only on the ground that the validity certificate is not produced.

The learned Addl. G. P. accepts notice of Respondent Nos. 1, 2 and 4. Mr. Sant, the learned advocate accepts notice for the Respondent No. 3. 3.

The Respondent No. 2/Committee shall decide the Tribe claim of the petitioner expeditiously and preferably within a period of four (4) months from the date of the appearance. The petitioner shall appear before the committee on 12.03.2018.

The Respondent No. 3 shall not withhold the result of the petitioner's final year M.B.B.S. examination, only on the ground that the validation proceeding is pending. Of course, the respondents shall not issue the degree certificate to the petitioner, unless validity certificate is submitted. In case, the petitioner is eligible and complies with all the requirements, then the respondent shall consider the claim of the petitioner for internship on its own merits.

The writ petition is disposed. No costs.
