IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 1020 WRIT PETITION NO.3186 OF 2019 LAXMIBAI KISHANRAO ALLEWAR ..PETITIONER

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ..RESPONDENTS WITH WRIT PETITION NO.3187 OF 2019 WITH WRIT PETITION NO.3188 OF 2019 WITH WRIT PETITION NO.3189 OF 2019 WITH WRIT PETITION NO.3190 OF 2019 WITH WRIT PETITION NO.3191 OF 2019 WITH WRIT PETITION NO.3192 OF 2019 WITH WRIT PETITION NO.3193 OF 2019 WITH WRIT PETITION NO.3194 OF 2019 WITH WRIT PETITION NO.3195 OF 2019 WITH WRIT PETITION NO.3196 OF 2019 WITH WRIT PETITION NO.3214 OF 2019 WITH WRIT PETITION NO.3373 OF 2019 ...

Mr. Anil H. Kasliwal, Advocate for the Petitioners in all writ petitions.

Mrs. M. A. Deshpande, AGP for Respondents-State. ...

(2) CORAM : S. V. GANGAPURWALA & MANGESH S. PATIL, JJ.

DATED : 13th JUNE, 2019.

PER COURT:- 1.

We have heard Mr. Kasliwal, learned counsel for petitioners, Mrs. Deshpande, learned A.G.P..

2.

The affidavits are filed in some of the cases. The licences are renewed up to year 2020 and in some up to the end of 2019.

3.

It is not disputed that the liquor licences are issued to petitioners prior to the notification dated 04.03.2015.

4.

In light of the above, the judgment delivered on 23.11.2016 in Writ Petition No.3390/2015 with connected writ petitions of this Court at Nagpur Bench would squarely apply.

5.

In light of the above, we pass the following order:

"For the reasons recorded in the judgment dated November 23, 2016 in Writ Petition No.3390/2015 with connected writ petitions (supra), we direct the respondents to consider the application of the petitioners for renewal of their licences without insisting upon the resolution of the Gram Sabha No Objection as required under Rule 4 of the Rules of 2015."

(3) 6.

Writ Petitions are accordingly allowed.

No costs.

(MANGESH S. PATIL) (S. V. GANGAPURWALA) JUDGE JUDGE Devendra/June-19
