Mr. Barlinge, learned Advocate submits that during the pendency of this writ petition, the respondent has issued Experience Certificate and some amount is paid, however, the amount is not as per the pay-scale applicable.

According to learned Advocate Mr.Hon, the amount is paid to the petitioner as per the order of the Grievance Committee and the Experience Certificate is also given. No amount is due and payable to the petitioner.

The dispute is with regard to the applicable pay-scale to the petitioner. The order of the Grievance Committee does not specify the pay-scale to which the petitioner is entitled to, though the Grievance Committee has passed order directing the respondents to pay difference of the salary from the date of joining the service.

The order to the extent of the Experience Certificate has been complied with.

In the aforesaid scenario, we direct the petitioner to approach the Jt. Director of Higher Education, Jalgaon Division, Jalgaon with regard to the applicable pay-scale. The Jt. Director of Higher Education, Jalgaon Division, Jalgaon shall after considering the case put-forth by the petitioner and also after hearing the respondent/management, shall take decision on the applicable pay-scale and the amount

( 3 ) entitled to by the petitioner within a period of three months from the date of application received from the petitioner.

With these observations, the writ petition is disposed of. No costs.
