The learned counsel for the petitioner submits that, the Divisional Commissioner has passed an order thereby allowing the appeal and directing that the petitioner be posted at Walunj in Nagar Taluka. The order is not implemented. The posting is not given to the petitioner. The representation is also made to the Divisional Commissioner in that regard, but as yet no decision is taken.

The learned Assistant Government Pleader appears for respondent Nos. 1 and 2.

In case representation of the petitioner page No. 50 is pending with the respondent No. 3, then the respondent No. 3 shall take decision upon it, on it's own merits, in accordance with

In the light of the above, the writ petition is disposed of. No costs.
