Present writ petition takes exception to the order dated 1.3.2024 passed by the learned Presiding Officer, School Tribunal, Nashik in appeal no.44 of 2014, by which, appeal filed by the petitioner, assailing order of termination dated 29.7.2014, and further seeking relief of reinstatement with continuity in service alongwith full back wages is dismissed. 2.
During pendency of present writ petition, parties have arrived at amicable settlement outside the Court and placed on record terms of the compromise, which are signed by the petitioner Ravindra Anna Pawar and President of the respondent no.1-Vijay Pandharinath Mahajan. Compromise

As per compromise, Respondent/Management has withdrawn termination order dated 29.7.2014 and shown readiness to reinstate the petitioner on a aided and clear vacant post available in the School run by the Management i.e. Mahatma Phule High School at Erandol.

Learned advocate appearing for the respondent/Management, on the basis of written instructions/ authority letter dated 14.8.2025, copy of which is placed on record and marked as Exhibit X-1 for identification makes a statement at bar that reinstatement of petitioner shall be with continuity of service i.e. from initial date appointment i.e. 15.6.2012. The petitioner has agreed to forgo/relinquish the claim of back-wages in view of the Management's agreement to reinstate him with continuity of service.
