When this Court shown its disinclination to grant relief to the petitioner, learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition.

Criminal Writ Petition is disposed of as withdrawn. 3.

Learned counsel for the respondent states that the criminal proceeding is pending before JMFC since the year 2012 and crossexamination of the accused was over on 05/10/2015. It seems that the petitioner is dragging the said proceeding without any reason and therefore though the petition is withdrawn, the withdrawal is allowed with cost of Rs.1,000/- (Rupees One Thousand only) payable to the respondent.

Learned Trial Court is directed to dispose of the proceeding bearing SCC No. 185/2012 within a period of three months from the order of this Court.
