Heard learned Counsel for the petitioner. On a grievance that the order dated 29.09.2016 passed by Division Bench of this Court in Writ Petition No.7365 of 2015 is not complied with, this Contempt Petition was filed. In response to notice issued by this Court, learned Counsel Mr. Shelke appearing for added respondent No.3 Ramakant Kathmore, Education Officer (Primary), Zilla Parishad, Ahmednagar placed on record a communication dated 11.09.2019. Affidavit-in-reply is

(2) filed on behalf of respondent No.3. In the communication dated 11.09.2019 it is stated that there was a demand submitted by the petitioner for 100% salary grants. Mr. Shelke, the learned Counsel for respondent No.3, by inviting our attention to the statement made in the communication dated 11.09.2019, submitted that the petitioner was granted 80 % salary grants from year 2009-2010 and now his grievance of remaining 20% grant is also addressed and redressed to. Thus, the petitioner would be entitled for the entire 100 % grants. Mr. Shelke also submitted that accordingly funds would be released by the Government and after receipt of funds the amount would be released in favour of the petitioner. Mr. Shelke also invited our attention to the communication addressed to the Head Master Sou.

Subhadrabai Baburao Gaikwad Primary School, Shrirampur calling upon the Headmaster to submit the salary bills immediately to the Pay Unit. The communication addressed to Headmaster reiterates the statement that as soon the funds are received from the Government, the amount of arrears of remaining 20% would be released in favour of the petitioner. 2.

Mr. Jadhavar, learned Counsel for respondent Nos.1 and 2 submitted that as the communication is issued on

(3) 11.09.2019, it may reach to the respondent Nos.1 and 2 within a couple of days.

In view of the communication dated 11.09.2019, we direct respondent Nos.1 and 2 to submit the salary bills of the petitioner to the Pay Unit, Zilla Parishad, Ahmednagar before 26 September 2019.

The petition is disposed of accordingly.
