CIVIL APPLICATION NO. 14544 OF 2019 Heard the learned counsel for the claimants and the learned APP for the respondent / State. Perused the application. This is an application for condonation of delay of 794 days caused in filing the cross-objection.
36.odt The learned AGP for respondent No.2 strongly opposed the application and submitted that there is no sufficient reason to condone the delay.
On perusal of the application and for the reasons stated therein, this Court is of the view that the delay has not been caused deliberately. The claimants are villagers having no knowledge of the law. Therefore, in the interest of justice, the delay deserves to be condoned on certain conditions.
For the reasons stated in the application, the delay stands condoned. The application stands allowed in the interest of justice. The cross-objection be registered.
It is made clear that in case the amount of compensation is enhanced, the claimants shall not be entitled for the amount of interest and other statutory benefits for the delayed period. Cross-Objection:
