5. The learned advocate waives notice for respondent No. 3. 2.

This court under order dated 22nd September, 2016, in Writ Petition No. 3203 of 2016, had directed the committee to decide the validation proceeding within nine months and refrained the respondents from taking further action. However, it appears that the notice is issued to cancel the admission of the petitioner, if the validity is not submitted.

It is further submitted that result of the petitioner's 2nd year M.B.B.S. winter - 2017, is also withheld. 4.

When this court has passed the order earlier, it is expected that the committee abides by the order. We are extending the time to decide the validation proceeding by four (4) months from today. The petitioner shall appear before the committee on 12th March, 2018. The impugned communication is quashed and set aside. The respondent shall not withhold the result of the petitioner's examination only on the ground that validation proceeding is pending nor shall refrain the petitioner from prosecuting further studies, if the petitioner is otherwise eligible. The respondent can take further course of action depending upon the order that would be passed by the committee in the validation proceeding.
