This is an application by the original applicant in Anticipatory Bail Application No.790 of 2020, seeking withdrawal of an amount of Rs.50,00,000/- deposited by him in this Court pursuant to the order dated 15.09.2020 to show his bona fides while seeking bail. 3.

The learned A.P.P. submits that since the matter arises out of the provisions of the Maharashtra Value Added Tax Act, it would be appropriate to hear the original complainant before passing any order. 4.

I have carefully considered the papers.

It was a matter regarding grant of anticipatory bail. In order to show his bona fides, the applicant had voluntarily expressed his willingness to deposit the money. This Court had permitted him to do so. By the order dated 18.01.2021, his application for anticipatory bail has been rejected. 6.

Considering the aforementioned state-of-affairs, there is no ground or propriety in allowing the money to be retained in this Court. 7.

The application is allowed. The amount, which stands deposited in this Court by the applicant, shall be refunded to him with interest, if any accrued thereon. The application is disposed of. [MANGESH S. PATIL] JUDGE npj/CRIAPLN467-2021
