Heard learned counsel for the applicant as well as learned counsel for respondent no.2.

None appears for respondent no.1, though duly served.

Delay of 113 days in filing the present appeal is sought to be condoned by the appellant-original claimant, who is aggrieved by the direction of the learned Commissioner under the Workmen's Compensation Act, exnorating the Insurance Company in payment of the compensation.

Learned counsel for the applicant submits that as communication gap has occurred between the trial Court Advocate and the High Court Advocate, the delay is caused.

Sufficient reasons are made out. The Application is allowed. Delay is condoned.
