It is an application for condonation of delay moved by the applicant/The Reliance General Insurance Co. Ltd. Aurangabad. 2.

Heard Mr Patil, learned counsel for the applicant/Insurance Company, Mr V.R. Mundada, learned counsel for respondent No. 3 and Mr A.S. Salve, learned counsel for respondent Nos. 4 and 5. Mr J.I. Shaikh, learned counsel for respondent Nos. 1 and 2 remained absent when the matter is called out.

On perusing the record, it is revealed that there is delay of 27 days in preferring the first appeal. Mr Salve, learned counsel for respondent Nos. 4 and 5 has no objection to condone the delay. Mr V.R. Mundada, learned counsel appearing for respondent No. 3 has no

2 906-CA-7288-2020 objection to condone the delay. Moreover, having regard to the volume of delay of 27 days and in view of reasons assigned by the applicant in para Nos. 4 and 5, the delay needs to be condoned to meet the ends of justice and to decide the appeal on its own merits.

ORDER

(I) The application for condonation of delay moved by the applicant is hereby allowed.

(II) The Registry to register the appeal after due scrutiny as per procedure and it be numbered and placed before the Court for admission.
