Heard learned counsel for the applicant. The respondent despite service remain absent. The applicant is seeking transfer of the Marriage Petition No. 579 of 2016 filed by the respondent husband for getting divorce, from the Court of C.J.S.D., Kalyan to the Court of C.J.S.D., Dhule.

The learned counsel for the applicant submits that the applicant is not having any source of income. Further she has to maintain one daughter aged about 7 to 8 years. The distance between Dhule and Kalyan is more than 200 k.m. Moreover, the applicant has also filed PWDVA proceedings No. 18 of 2016 in the Court of J.M.F.C., Shirpur, wherein the respondent has already appeared. A recovery proceedings bearing Cri. Misc. Appln. No. 67 of

947mca155.21 2019 is also going on in the Court of J.M.F.C., Shirpur for the recovery of maintenance amount. In view of the same, and considering the convenience of applicant wife, following order is passed :

ORDER

i) The application is allowed.

ii) The Marriage Petition No. 579 of 2016 is hereby transferred from the Court of C.J.S.D., Kalyan, District Thane to the Court of C.J.S.D., Dhule, for disposal according to law.

iii) The respondent is directed to appear before the Court of C.J.S.D., Dhule on or before 02.01.2023.
