As far as the challenge to the notification is concerned, we do not see any reason for the challenge.

As far as the challenge of penalty is concerned, the learned A.G.P. submits that the petitioner has an alternate remedy against imposition of penalty.

In case, the petitioner is aggrieved by the imposition of the penalty, then the petitioner may avail the alternate remedy as may be permissible under law. In that event, all contentions are kept open. 4.
