The learned counsel for the petitioner submitted that the petitioner has vacated the suit premises, i.e. Shop (CTS No.7985), and has tendered across the bar the photographs of the vacation of the shop. The same is taken on record and marked "X" for identification purposes. 2.
The son of the petitioner is also present in the Court, who has handed over the key of the said shop to the learned counsel for the respondent in the Court, and the learned counsel for the respondent has Shrikant Malani
901.CA.9065.2021.odt accepted the same. Therefore, the learned counsel for the petitioner submitted that, in view of the above, Nothing is survived in the petition and should be disposed of, to which the learned counsel for the respondent has consented and given no objection.
