Heard all the learned advocates for applicants and the learned APP.
The learned APP submits that during the pendency of these applications, offences punishable under Sections 3 and 4 of the M.P.I.D. Act have been added in the FIR against the applicants. Hence, the applicants have to approach the Special Court for seeking fresh anticipatory bail. The learned APP produces report of the investigation officer. It is taken on record. All the learned advocates for applicants submit that the interim protection is granted to the applicants in the month of February, 2024. Since then, they are enjoying the interim protection. If they are directed to approach the Special Court, the investigating officer may arrest them. Hence, protection be given to them till the first date of
actual hearing of their bail applications before the Special Court and, on instructions, they seek leave to withdraw the applications with liberty to file fresh anticipatory bail applications before the Special Court.
Considering the submissions of all the learned advocates for applicants and the learned APP, leave granted. All the anticipatory bail application are disposed of as withdrawn with liberty to file fresh anticipatory bail applications before the Special Court. The interim prosecution granted till date, be continued till the first date of actual hearing of the anticipatory bail applications before the Special Court.
