Mr. Ambetkar, learned counsel for the petitioner submits that, the land of Grampanchayat was acquired for the purpose of installation of 3 MW solar energy project. According to the learned counsel, the Convergence Energy Services Limited now has said that 1.8 MW electricity may be generated, that would not sub-serve the purpose of the villagers and purpose for which the land is acquired would not fructify.

It appears that, as per the DPR submitted to MSEDCL by Convergence Energy Services Limited for Shirapur, the proposed capacity of the site was 2 MW. Under letter dated 22.02.2022 the tentative
(2) 44-wp-3226-2022 capacity now proposed is 1.8 MW. It was further submitted that, the capacity may increase or decrease as per the final land development and array lay out.

The capacity may depend upon various aspects. In fact, the petitioner ought to have first approached to the MSEDCL for seeking necessary clarification and depending upon the reply may take further steps.

With the aforesaid liberty, Writ Petition is disposed of. No costs.
