I have heard Mr. Wani, learned Counsel for the Petitioners.

The Petitioners appear to be the Original Defendants. The Suit for Injunction is filed by the Respondent. Alongwith the Suit, an application for temporary injunction under order 39 Rule 1 and 2 of the Code of Civil Procedure, 1908 is filed. The Trial Court granted temporary injunction. The present Petitioners filed an Appeal before the District Court. The District Court dismissed the Appeal.

It would appear that since the date of filing of the Writ Petition there are no interim orders in favour of the Petitioners.

By now the Suit also must have been disposed of. No purpose would be served by adjudicating the matter on merits.

In case, the Civil Suit No. 100 of 2011 filed before the Civil Judge Junior Division, Jamner is not disposed of then, the Trial Court shall endeavour to dispose of the Civil Suit expeditiously.

The Writ Petition is accordingly disposed of. No costs.
