This is the Application for condonation of 2656 days delay in preferring the First Appeal by the Original Claimants for further enhancement of the compensation.

The learned AGP for Respondent No.1 is present. 3.

According to the Applicants, they could not prefer the Appeal within the prescribed time due to financial constraints. The learned Advocate for the Applicants tendered across the bar copy of the order dated 11.07.2023 passed by this Court in connected matters i.e. in CA No.5977 of 2020 in First Appeal (St.) No.27531 of 2019 by which delay of 2489 days is condoned.

The learned AGP does not dispute the aspect that in the connected matters delay has been condoned.

After hearing both the sides and for the reasons mentioned in paragraph nos.2 and 3 of the Application, the application is allowed in terms of prayer clause '

B'. The Applicants shall not be entitled for the

interest and statutory benefits for the aforesaid delayed period. Copy of this order be kept in the order sheet of the Appeal memo. Civil Application stands disposed off accordingly.
