Present application has been filed for getting the delay of 3033 days condoned in filing criminal appeal. Applicant is the original accused in Sessions Case No. 74 of 2009, who has been convicted by the learned Ad-hoc Additional Sessions Judge-2, Ambajogai, District Beed, on 31.08.2010, after holding him guilty of committing offence punishable under section 302 of Indian Penal Code (IPC).

Learned APP submits that the delay is huge.

Certainly, the delay is huge and though it appears that the application was filed in the year 2019, it was not even got circulated. The fact remains that in view of the oral directions

-2- 905-Cri.Appln.684.2019 given to learned APP, he is submitting that the appellant/applicant is still in jail. Earlier, he was at Nashik Jail, however, now he is in Harsul Jail, Aurangabad.

Taking into consideration the reasons stated in paragraph nos.3 and 4, grounds are shown for condoning the delay and therefore, application stands allowed and disposed of. Delay stands condoned.
