The petitioners who claim to be from amongst the depositors of the same financial institution in respect of which crime has already been registered, are seeking consideration of their representation by the concerned P.I. and the Economic Offences Wing. 2.

Having seen that already a crime has been registered inter alia for the offences punishable under Section 3 of the MPDA Act, learned Advocate for the petitioner seeks leave to withdraw the writ petition with liberty to approach the trial Court, seeking the remedies as are available to them in the light of Vinubhai Hirabhai Malaviya V. State of Gujarat, reported in (2019) 17 SCC 1.

The Criminal Writ Petition is disposed of as withdrawn with liberty as prayed for.
