The learned counsel states that now the auction is scheduled on 7.3.2017. In fact, in the present Writ Petition, the auction dated 30.1.2016 is assailed. On the said date the auction never took place for the said year and now as per the petitioner fresh auction is scheduled on 7.3.2017. The same is not the subject matter of the present Writ Petition.

Be that as it may, the auction for every year has to be based on the circumstances existing in that year. Merely because in the year 2014, the objection of the petitioner was rejected by the Committee can not be a ground, not to approach the Committee.

The petitioner may approach the Committee constituted in this regard. In case such objection is filed by the petitioner, the Committee shall consider the same expeditiously and take decision upon it preferably within fifteen (15) days, so also shall consider on its own merits if any stay petition is filed. 5.

The Writ Petition is disposed of. No costs.
