BORDE, J (Date: September 4th, 2017) ORAL ORDER The petitioner is objecting to the concurrent orders passed by the Cooperative Court as well as the Cooperative Appellate Court, directing dismissal of the Dispute, presented by him as well as the Appeal, challenging the order passed by the Cooperative Court.
Perused the order passed by both the Courts.
{2} wp 7072.13.odt The finding of the fact recorded by the Courts below that the petitioner has failed to establish his contentions as regards fabrication of the documents, particularly letter of resignation and other record, at the instance of Cooperative Society, held to be in the negative, need not be interfered with, in exercise of extraordinary jurisdiction under article 227 of the Constitution of India. The Society has established the validity of the Resolution adopted, where-under, the resignation tendered by the petitioner has been accepted.
In view of above, no interference is called for. The petition is devoid of substance and stands dismissed. (R. M. BORDE, J) vbd
