Heard the learned Counsel for the applicants. None for the respondent, though served.

By way of this application, the applicants are seeking transfer of the proceedings filed before the Family Court at Aurangabad to Family Court at Nanded.

The learned Counsel for the applicants submits that it is not possible for the applicants to attend the proceedings by travelling from Nanded to Aurangabad. The applicant is a minor and residing with his paternal grandmother.

I have considered rival submissions. I record following findings.
178.MCA-66-2022.doc (i) The applicant no.1 is minor who is prosecuting this application through applicant no.2, grandmother.
(ii) It is inconvenient for the applicant with his grandmother to travel and attend the proceedings at Aurangabad.
(iii) The applicant has already withdrawn PWDVA Case No.419/2019. Application survives for Petition D-29/2019.
(iv) The respondent is able bodied and in a position to attend the matter.

For the reasons stated above, I pass following order.
ORDER
a.
The Miscellaneous Civil Application is allowed. b.
The Petition D-29/2019 pending before the Family Court at Aurangabad shall stand transferred to the Family Court at Nanded.
c.
An endeavour be made to decide the proceedings finally as expeditiously as possible.
d.
The concern court shall transmit the papers immediately. e.
The parties to appear before the Family Court at Nanded on 03.01.2024.
f.
All the proceedings pending at a place where the applicant is residing be preferably posted on same date.
