1) The application is filed for bail Both the sides are heard.
2) This is second application for bail. Previous application, Criminal Application No.5257/2016 was withdrawn by the applicant and at that time, this Court had fixed time of four months for disposal of the case. Time was fixed on 21-11-2016. The learned counsel for the applicant submitted that though charge came to be framed in December 2016, the case has not made any progress that is why present proceeding is filed.
2 Application 1126 of 2017 3) The aforesaid circumstance was argued as change in circumstance. This Court has carefully gone through the record. Charge sheet is filed for offences punishable under sections 363, 366A, 376 of the Indian Penal Code and some provisions of the Protection of Children from Sexual Offences Act, 2012. The age of the prosecutrix was 16 years at the time when she was virtually deceived by the present applicant. In view of these circumstances this Court holds that only direction which can be given to the trial Court is to dispose of the matter within fixed period. So, the application stands rejected. The trial Court is directed to dispose of the case within three months from the date of receipt of this order. Sd/- (T.V. NALAWADE, J.) rsl
