The Registrar (Judicial) of this Court has taken instructions with regard to the pendency of suit and as per instructions, the suit bearing RCS No.373 of 2001 came to be disposed of by the trial Court.

Learned counsel Mr. V.R. Dhorde holding for Mr. D.D. Karpe for the petitioner submits that even this Court while granting Rule on 25.02.2003, directed the learned trial Judge to dispose of the pending suit viz. RCS No.373 of 2001 by the end of June 2003.

Pending this writ petition, the interim relief in terms of prayer clauses 'C' and 'D' only granted and in view of that the further proceedings in the suit are not stayed. Thus by disposing of the suit, this writ petition has become infructuous. The writ petition is accordingly disposed off. (V. K. JADHAV, J.) Sam..
