Heard Mr Nitin Jagdale, learned counsel holding for Mr V.D. Salunke, learned counsel for Respondent Nos. 1, 3, 4, 8 to 11 and 13. 2.

It is submitted across the bar that the parties have settled the dispute amicably out of the Court as per the terms agreed between the parties, the appeal needs to be disposed of.

The copy of compromise deed is placed on record along with Civil Application No. 9087/2021 at Exh. A-1. It seems that the dispute has been amicably settled between the parties. The necessary orders needs to be passed to that effect.

ORDER

(I) The Second Appeal No. 262/1994 stands disposed of in view of the amicable settlement between the parties.

(II) The decree be drawn up in terms of compromise deed which is produced vide Exh. A-1.

(III) No order as to costs.

(IV) In view of disposal of Second Appeal, the Civil Application Nos. 9087/2021, 424/2003, 2757/2011 and 7524/2002 are disposed of.
