29-03-2022 PER COURT :- The matter was mentioned by the learned Advocate for the petitioner yesterday for urgent circulation on the ground that respondent no. 3 has passed oral order in the Revision Application filed by the petitioner, which would prejudice the rights of the petitioner.

Learned A.G.P. tenders a copy of letter dated 28.03.2022 from the Sub-Divisional Officer, Paithan-Fulambri, Aurangabad, addressed to the learned A.G.P. stating that, the hearing of the Revision Application filed by the petitioner is kept on today. 3.

Learned Advocate for the petitioner today states that no such oral order is passed by the Sub-Divisional Officer. The statements made by the learned counsel for the petitioner are inconsistent.

In our view, the Writ Petition is thoroughly misconceived and accordingly dismissed.

We are disturbed with the fact that such petitions have been filed having no cause of action and though not maintainable resultantly waste of time of this Court.

We hope that, such type of petition shall not be filed in future by the petitioner. Though at this stage, we had decided to pass an order as imposing exemplary costs, the petitioner being an agriculturist, we do not propose to impose exemplary costs, on the assurance of the learned counsel for the petitioner that no such type of petition would be filed in future.
