The learned counsel for petitioners submits that, the Commissioner of State Excise has set aside the order passed by the Collector thereby closing the business of FL/BR-II and CL-III license of petitioners and remanded the matter to the Collector to take fresh decision of restoring the business of petitioners. The learned counsel submits that, the Collector on 17th February, 2020 directed the Superintendent State Excise to take the necessary decision. More than one year has lapsed no decision is taken.

Issue notice to respondents. The learned A. G. P. accepts notice for all respondents.

In case the matter after remand is pending with the

2 wp 5188.21 respondent No. 4 (page 43), then the respondent No. 4 shall take decision upon it, on its own merits, in accordance with law, expeditiously and preferably within a period of four (04) months from today.

In the light of the above, the writ petition is disposed of. No costs.
