Mr.More, learned counsel submits that validation proceedings in respect of caste claim of the petitioner is pending with the Committee since the year 2015. Learned counsel submits that the Tahsildar has issued notice, thereby, initiating proceedings for disqualification of the petitioner on the ground that validity certificate is not submitted. The learned counsel submits that the Apex Court on 13.2.2017 has granted stay to the judgment of the Full Bench of this Court in the case of "Anant H. Ulahalkar and another Vs. Chief Election Commissioner and others" reported

in 2017 (1) Mh.L.J. 431.

Learned A.G.P. submits that the Committee would decide the proceedings in accordance with law expeditiously. 4.

It appears that the Vigilance is already conducted. If no date of hearing is communicated to the petitioner then the petitioner shall remain present before the Committee on 16.3.2017. The Committee shall decide the validation proceedings in respect of the caste claim of the petitioner expeditiously, preferably within three

(3) months from the date of appearance of the petitioner. 5.

The petitioner may point out the judgment of the Apex Court granting stay to the judgment of the Full Bench of this Court before the authority, who had initiated the proceedings. The authority is bound to consider the said fact. 6.

The Writ Petition is disposed of. No costs.
