This is a Writ Petition for setting aside the order dated 17.01.2022 passed by the D.I.G. Prison Central Division, Aurangabad.

Learned APP points out that there is an alternate efficacious remedy available, as the Petitioner can challenge the impugned order by way of appeal before the I.G. Prison.

In view of this submission of the learned APP, learned Counsel for the Petitioner does not press this petition and submits that the

2 Cr.wp 321.2022 petitioner would file appeal in accordance with law.

Considering these submissions, the petition is disposed of as not pressed. If the appeal is preferred, the competent authority shall take into consideration pendency of this petition while considering the question of delay.
