Heard the learned counsel for the applicants, learned APP for the respondent-State and the learned counsel for the first informant/injured.

After hearing the respective learned counsels, the Court expressed disinclination to grant bail in favour of applicant No.2 ARVIND VISHNU SHINDE. The learned counsel for the applicant, on instructions, seeks leave to withdraw his application. Leave granted. His bail application stands dismissed as withdrawn.

As far as the role attributed to applicant No.1 Vishnu is concerned, he has been shown present on the spot of the

incident. There was a free fight between two groups. They assaulted each other and caused the injuries. The role attributed to applicant Vishnu is limited. There was a history of dispute over the daughter of applicant Vishnu. It would not be appropriate to make any comment over the history as the investigation is in progress. However, considering the role attributed to applicant Vishnu, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is partly allowed.

(ii) Applicant No.1 VISHNU NARAYAN SHINDE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.23 of 2023, registered by Police Station Manwath, District Parbhani, for the offences punishable under Sections 307, 326, 504, 506 read with Section 34 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice.

(iii) Criminal application No.979 of 2023 to assist the learned APP is allowed.
