Heard Shri Banik, learned counsel for the applicant. All the respondents are served but none of them has caused appearance. 2.

Delay of 83 days is caused in preferring the appeal. It is alleged in the application that the applicant was not aware about passing of the decree by the appellate Court. Time was consumed in making the fnancial arrangement for preferring appeal. Delay is not intentional.

Having regard to the allegations made and the fact that no one has appeared to contest the application, I am inclined to condone delay subject to cost of Rs. 2,000/-. On depositing cost, the appeal be registered, if it is otherwise ft for registration. Civil Application stands disposed of.
