This application is filed seeking condonation of 57 days delay caused in filing second appeal.

Heard learned counsel for the Applicant. Nobody turned up for the original plaintiff.

In view of the contents of the application and submissions made, this Court holds that the delay needs to be condoned. However, as the plaintiff, who has filed the suit in the year 2000, is required to spend on present proceeding, the application is allowed subject to

-:(2):- payment of costs Rs.2,000/- by the applicant to original plaintiff. The amount is to be deposited in this Court within four weeks from today. If the amount is not deposited, within the aforesaid period, the matter to be treated as dismissed.
