This application is preferred for withdrawal of the amount deposited by the appellant/corporation in this Court pursuant to the impugned judgment and award.

The application is opposed by the learned Advocate for the Corporation stating that there are chances of success in the appeal, as good grounds are raised while challenging the judgment and award. 03.

Considering the submissions, this Court is inclined to pass the following order :-

ORDER

(i) The applicants are allowed to withdraw 50% of the deposited amount on furnishing usual undertaking.

( 2 ) ca3536.23 (ii) Further 25% of the deposited amount is allowed to be withdrawn subject to furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court. (iii) Remaining 25% of the amount shall be invested in fixed deposit of any nationalized bank, to be renewed periodically till disposal of the appeal.

(iv) The civil application is accordingly allowed and is disposed off.
