The learned advocate for the petitioners submits that the present writ petition arises out of the interim order passed in civil suit, subsequently, the plaint is rejected for want of jurisdiction. The learned counsel submits that thereafter, the plaintiff has filed first appeal which is pending for adjudication and in view of the same, the present writ petition has become infructuous. The learned counsel for the petitioner, on instruction, therefore, seeks leave of this Court to withdraw the writ petition and placed the written communication received from the petitioners on record. 2.

In view of the submissions made above, the writ petition is disposed of as infructuous. However, liberty is granted to the petitioner to revive the writ petition in the event, the appeal is allowed. Civil applications, if any, stand disposed of.
