1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 514/2024, registered with Vazirabad Police Station, Dist. Nanded, for the offence punishable under Section 109, 126 (2), 351 (3), 3 (5) of BNS and Section 3/25, 4/25 of the Arms Act.
3] The allegation against the applicant is that he has assaulted the informant by means of pistol, so also, there are seven antecedents against the present applicants. The name of the applicant is mentioned in the FIR.
321.25ABA 4] Considering that the applicant has assaulted the informant by means of pistol and that there are various antecedents against the present applicants, this is not a case to grant anticipatory bail in favour of the applicant. Hence, the present application is dismissed.
5] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall not be influenced by the observations of this Court while deciding regular bail or at trial.
