..

Respondents Mr.Bharti B. Gunjal, Advocate (appointed) for the petitioner. Mr. K.S. Patil, A.P.P. for respondent/State.

CORAM :

A.V.NIRGUDE & INDIRA K. JAIN, JJ.

DATED :

18.03.2016 P.C. :- 1.

Heard. Equally efficacious remedy is available to the petitioner for challenging the impugned order. In our view Rule-2 of the Prisons (Bombay Furlough & Parole) Rules, 1959, after amendment, gives ample latitude to a convict for challenging all types of orders refusing furlough leave, by filing an appeal. The impugned order is appellable under Rule-2 of the said Rules.

2.

The criminal writ petition stands disposed of. 3.

The learned Counsel for the petitioner who is appointed as amicus curiae be paid Rs.1500/- (Rupees One Thousand Five Hundred) as legal fee.
