Both the sides are unanimous that several First Appeals preferred by the acquiring body have been disposed of from time to time by this Court by passing separate judgments namely First Appeal No. 3023/2013 with connected matters, First Appeal No. 592/2002 with connected matters, First Appeal No. 35/2003 and connected matters and First Appeal No. 353/2003 and connected matters. They submit that even this appeal can be disposed of in terms of that judgment.

In view of such state of affairs, this First Appeal is disposed of in terms of the judgment and order dated 05.02.2013 passed in First appeal No.

45FA640.03.odt 3023/2013 and shall stand partly allowed.
