Heard learned counsel for the applicants and respondent No. 1-original claimant.

Perused the application.

The learned counsel for respondent-Insurance Company submits that the applicant-claimant had already received nearabout Rs.14,00,000/-(Rupees Fourteen Lakhs) on account of death of her son in vehicular accident. The claimant had also received compensation amount in another proceeding initiated for claiming compensation towards death of her grand-daughter. Learned counsel for Insurance Company submits that the applicant - Meerabai received near-about Rs. 20,00,000/- (Rupees Twenty Lakhs) towards compensation for death of her son and grand daughter.

4. Learned counsel for the applicant submits that the applicant Meerabai has no any relative, her husband Anandsingh passed away long back. She is alone and hapless lady, in need of money for medical treatment etc. Therefore, learned counsel prayed to allow the applicant for withdrawal of some of the part of decreetal amount lying in this court.

Taking into consideration the factual aspects that applicant is the lone senior citizen having no relative and she had already received Rs. 20,00,000/- (Rupees Twenty Lakhs) recently in both the proceedings as compensation towards death of son and grand daughter, it would hard to believe that the applicant is in need of money. The contentions propounded on behalf of applicant smacks something fishy and not acceptable. Therefore, application liable to be rejected.

Accordingly, application being devoid of merit and stands rejected.
