Heard learned counsel for the applicant, APP for the State and perused the impugned Judgment & Order.

Learned counsel for the applicant submits that the applicant has deposited Rs. 20,000/- (Rupees Twenty Thousand) in the Court as against the Cheque of Rs. 48,000/- dishonoured pursuant to the conditional order passed by the trial Court. He further submits that, the applicant is ready and willing to settle the

2 APPLN1136.2017 matter and to show his bona fide to settle the matter, the applicant is ready to deposit further amount of Rs. 28,000/-. 3.

Having regard to the submissions advanced and the willingness shown by the applicant to deposit the balance amount to the extent of cheque, I am inclined to allow the application on condition of applicant to deposit Rs. 20,000/- as a pre-condition to be enlarged on bail and further to deposit Rs. 15,000/- within a period of four weeks from the date of release. Hence, the following order.

ORDER

(I) The execution of substantive sentence awarded by the trial Court stands suspended and the applicant be enlarged on bail on his furnishing bail in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with one surety in the like amount on pre-condition to deposit Rs. 20,000/- before the trial Court and further to deposit Rs. 15,000/- within a period of four weeks from the date of release before the trial Court.

(II) Bail to be furnished before the trial Court.

(III) Hamdast be issued.
