CORAM : V. K. JADHAV, J.
DATED : 23TH OCTOBER, 2020 PER COURT :- 1.
Heard both sides.
2.
It appears that the Special Land Acquisition Officer has awarded the compensation at the rate of Rs.800/- to Rs.1200/- per Are., however the reference court has enhanced the compensation at the rate of Rs.3950/- per Are.
Thus, considering the enhancement and compared to the sale instances produced before the reference court in support of the claim of enhancement, I am inclined to permit the applicants/original claimants to withdraw the amount to the extent of 75% on certain conditions. Hence the following order :
ORDER
I.
All the Civil Applications are hereby allowed. II.
Out of the compensation amount deposited before this Court, the applicants/original claimants are permitted to withdraw 25% amount on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court, 25% of the amount on furnishing solvent surety or solvent security to the satisfaction of the Registrar (Judicial) of this Court and further 25% amount on furnishing bank guarantee of any scheduled bank to the satisfaction of the Registrar (Judicial) of this Court.
III. The remaining 25% amount shall be kept in F.D.R. IV.
All the Civil Applications are accordingly disposed off. ( V. K. JADHAV, J. )
